The Firm advises life insurance and reinsurance companies on domestic regulation, conduct of business including regulation of general insurance, drafting of distribution, agency, outsourcing and other business agreements. Furthermore the Firm is advising on corporate issues affecting the start of an insurance/reinsurance business in Italy also by foreign operators, where we assist clients in their regulatory relations with IVASS, the set-up of entities and branches, business models, corporate governance, regulatory compliance, intragroup relations, extraordinary transactions (including M&A, portfolio transfers, business reorganisations, run-off, closure of operations, etc).

With regards to dispute resolution, the Firm assists Italian and foreign insurance companies doing business in Italy in a wide range of disputes, regarding insurance and reinsurance cover for losses of significant relevance. The Firm also practices insurance defence in complex cases. The experience mainly focuses on the following policies: D&O, Professional liability, Employee fidelity, General liability, Construction, All Risks, Product liability, Medical malpractice. As for life insurance, we assist insurers and distributors of insurance products in disputes relating to: regulation of insurance products with a financial content, banking/financial law issues, as well as product distribution and misselling. Further areas of practice are: clients’ representation before regulators (IVASS), professional liability of insurance and reinsurance brokers, commutation in the reinsurance.
